Lease
legally binding contract between a landlord and a tenant which grants the tenant possession and use of the landlord's property for a given period of time and the tenant undertakes to pay the landlord stipulated rent. It may be payable in money or other consideration.
Lease hold
a contract by which an owner of a specific asset (or rights) grants a second party the right to its exclusive possessions or use in return for a lease payment. In case of real properties the lease refers to agricultural land, sometimes other lands including investment lands. On the expiration of the lease the landlord is obliged to buy back the personal property situated on the land, whose removal is impossible or removal of which would result in the decrease of the their value. It applies both to agricultural crops as well as improvements.
Lease term
a period, calculated in months or years, for which a lease agreement is signed for. In case of new buildings the minimum period is 5 years. In older buildings shorter periods are allowed however the length cannot be less than 3 years. In accordance to the Civil Code a lease agreement between entrepreneurs signed for a definite period of time can be made for maximum 30 years. After this, the agreement becomes an agreement for an indefinite period of time.
Letter of Intent
written statement, where a tenant and a landlord agree to use all reasonable efforts to sign a leas agreement within a stipulated defined period. The Letter of Intent is signed at the moment when the tenant after the analysis of other offers has decided to proceed with the talks with one selected landlord. The Letter usually includes also the summary of commercial terms and conditions determined during previous tender stages regarding the choice of new space.
Local master plan (local spatial development plan)
an act of local law constituting the legal base for spatial development planning in the commune. The local development plan is prepared based on the land use plan. Building permit is issued on the basis of a local master plan. In the event of a lack of such a plan it is necessary to apply for outline planning decision (WZ).
